Defect Reporting Window vs Warranty Duration: Ask Two Different Questions

A defect reporting window concerns when and how an issue must be notified under the proposed arrangement. A warranty duration concerns how long a defined undertaking applies. Ask for the triggers, scope and interaction of both; matching dates do not make them the same obligation.

For buyers reviewing apparel defect-handling proposals.

Read the event that starts each period

Extract the start event from each proposed clause instead of comparing only its duration. Dispatch, receipt, acceptance and another named event are not interchangeable labels. Ask how a split delivery or delayed unpacking is treated if the proposal leaves that unclear. Record dates only from confirmed project evidence. This exercise identifies questions in the documents; it does not supply a legal deadline or assume that a familiar warranty phrase has a standard meaning across markets.

Separate covered issues from reporting mechanics

For a warranty proposal, ask which goods and issues it expressly covers and what conditions or exclusions are stated. For notification, ask what information and channel the proposed process requires. A broad description of covered defects may coexist with a narrow reporting instruction, so both need attention. Keep the observed issue description distinct from an assertion that it qualifies for a remedy. The supplier’s acknowledgement of a report is also different from acceptance of responsibility.

Ask what happens when the periods interact

Present the parties with the specific ambiguity: an issue is observed within one described period, but a different clause appears to require an earlier notice. Request a written explanation of the intended handling and appropriate review where contractual rights are involved. Do not resolve that conflict by choosing whichever period is longer. Equally, do not declare that a short reporting instruction cancels every other undertaking. The actual agreement and relevant review must determine the effect.

Prepare an evidence record without promising an outcome

Keep the order and shipment references, observation date, affected quantity basis and relevant photographs together. Record when and through which agreed channel the notice was sent, then preserve responses and subsequent instructions. Avoid editing the observation date to match a preferred period. If the parties authorize a remedy, record that decision separately. A well-organized report helps clarify the discussion, but it does not guarantee replacement, reimbursement or acceptance of a claim by any supplier.
